Jackson girl and ‘Wonder’ win in US Supreme Court disability decision

A girl and her dog are one step closer to victory in their lawsuit against her former school. The U-S Supreme Court said today that they can move forward with their lawsuit.

   After Ehlena  Fry was told she couldn’t bring her service dog Wonder to school with her, she took her case to court.

Attorneys for Fry’s school near Jackson said she shouldn’t be able to sue. They said she should have to go through an administrative process first.

The US Supreme Court says her family will need to demonstrate to a lower court that Fry needed the dog so she could be independent at school.

ACLU of Michigan represented Fry. Legal director Michael Steinberg says this is a victory.

 

“We believe the Supreme Court address exhaustion of administrative remedies the way it should have and it’s going to tear down barriers for kids with disabilities all throughout the country.”

Fry stopped going to the school soon after they prevented her from using Wonder. She’s now 13 years old and goes to school in the Manchester school district.
