court order

A judge has ordered a 62-year-old hunter safety instructor to stand trial on a lesser charge in the fatal shooting of a 13-year-old boy who was squirrel hunting in western Michigan. Roger Hoeker of Jenison was charged with involuntary manslaughter, but 78th District Court Judge H. Kevin Drake this week sent the case to circuit court on a charge of reckless discharge of a firearm.

A co-pilot convicted of being drunk while preparing for a charter airline flight has been sentenced to one year and one day in prison. Sean Michael Fitzgerald was also fined $5,500 on Friday. U.S. District Judge Robert Jonker said Fitzgerald's behavior was "simply intolerable." A Grand Rapids federal court jury convicted Fitzgerald in May of operating a common carrier under the influence of alcohol.

A man charged in connection with two slayings in Michigan is awaiting a key court hearing after being found competent for trial. The Kalamazoo Gazette reports judges in Kalamazoo and St. Joseph counties last month made rulings on competency after 32-year-old Zachary Patten of Portage underwent a psychiatric evaluation. He waived a key hearing in St. Joseph County to determine whether the case should go to trial and faces an Oct. 11 hearing on the same issue in Kalamazoo.

A federal judge has ruled two Michigan lawmakers must surrender to Tesla Motors Inc. records of their communications with lobbyists over a law barring the electric car maker from selling directly to customers. U.S. Magistrate Judge Ellen Carmody denied efforts by Republican Sen. Joe Hune of Gregory and Republican Rep. Jason Sheppard of Lambertville to quash the subpoenas in Grand Rapids.
